Arkansas Housing Laws

Arkansas housing laws are governed by the Civil Rights Act of 1968 given out by the Fair Housing Department of Arkansas. This act gives out certain housing laws within which the housing sector has to operate.

It is mandatory for each constructor or builder to abide by all the housing laws. If this is ignored then the grieved party has all the right to file a suit against the builder. The government has full right to interfere in the Arkansas housing laws.

Some of the Arkansas housing laws are as mentioned below:

1. According to title VIII it prohibits discrimination on the basis of race, religion, gender, nationality, family status.
2. The fair housing act also prohibits discrimination in all housing related issues like renting out an apartment or selling an apartment
3. Section 504 prohibits the discrimination on the basis of any kind of disabilities being suffered by the applicant for receiving financial assistance
4. Section 109 prohibits discriminations against receiving monetary assistance through HUD community program.
5. According to the ABA – Architectural Barriers Act passed in the year 1968, it says that all the constructions of buildings must be constructed in a way that it can be used by handicapped people also.
6. Executive order 11063 prohibits federal employment on the basis of religion, race, color, nationality and gender



According to the Arkansas fair housing commission there should not be any violation of the above mentioned laws. The AFHC works together with the HUD – housing and urban development of America to ensure that no housing laws are violated. The HUD offers affordable housing to all the people in the state. Their aim is to give equal opportunity to all the residents of Arkansas. The Arkansas fair housing commission investigates in to the matter of violations and takes strict actions against the accused. It ensures that discrimination of any sort does not happen, ever. In the year 2001, the AFHC decided that owning a house is a basic civil right and each individual of the state of Arkansas will be given this particular right. Any discriminations done, will be considered illegal and will be subject to a fair trail in the court of law.
